New York Bill Looking To Detain Sick People

    New York State Assemblyman Noah Nicholas Perry, a Democrat, just proposed a bill that would allow the governor to detain individuals who may pose “a danger” to public health.

    Assembly Bill A416 would allow the state to forcibly remove people or their children from their homes with “suspecting evidence” that they might be a carrier of a contagious disease. The bill even allows those without an illness to be detained by the state if they “had contact” with someone who might have been sick.

    The bill gives the opinion of the governor, currently Gov. Andrew Cuomo, who ultimately decides who poses “an imminent and significant threat resulting in severe morbidity or high mortality.” Cuomo or his surrogates could detain or remove anyone who is deemed a threat to the public over the coronavirus pandemic. This authority could be utilized anytime there is a state of health emergency declared due to an epidemic of any communicable disease.

    The bill was denounced by a handful of individuals, including the chair of the Libertarian Party of New York Cody Anderson who called this bill a clear and direct path to unconstitutional detainment, on the governor’s sole authority.

    “No US state was ever meant to have a single person acting as judge and jury, without checks or balances; if this bill is allowed to pass, that is exactly what New York will have. We once again demand that legislative leaders be principled when they claim “My body, my choice” – they must not pick and choose,” said Anderson.

    Others pointed out that Assembly Bill A416 was straight up detention camp stuff, giving any designated officials “full power” to remove any person/group of people from their homes if deemed contagious. It is liberal politicians like Gov. Cuomo who are spreading fear and unrest in what remains of New York.

    If the bill got passed, police would be dragged back into looking like the bad guys again. It would be unlawful and a sign of failed leadership if New York let their health commissioners hold this kind of power and violate basic human rights presented in the Constitution. The government does not give our rights, it either protects or violates them.

    Independent journalist and Fox News writer Kyle Becker pointed out a section of the bill that says a group of persons can issue a single order and detain someone in “a medical facility or other appropriate facility,” noting that it is CCP-level tyranny and not even close to constitutional.

    “NY’s proposed “law” would not be a law at all. It flagrantly, blatantly & explicitly violates the Fourth Amendment rights of ALL American citizens. This is arrest without due process rights. It is the kind of Intolerable Act our Founders went to war over,” Becker tweeted.

    While President-elect Biden is hard at work in ending the second amendment and big tech companies look at abolishing the first, New York State is trying to get rid of the Fourth. Democrats are trying to break apart the Constitution piece at a time, but their party will just keep growing more hopeless and desperate until they finally push the reset button on their party altogether.
