Former Trump Campaign Adviser Sues The FBI And DOJ

    Former 2016 Trump campaign adviser Carter Page just filed a 59-page lawsuit with the U.S District Court for the District of Columbia, including fired FBI Director James Comey, fired assistant director Andrew McCabe, fired FBI deputy assistant director of counterintelligence Peter Strzok and former FBI lawyer Lisa Page. The lawsuit includes allegations of unjustified and illegal actions using Foreign Intelligence Surveillance Act orders, as well as unlawful investigations done by the United States.

    The FBI’s investigation of Carter Page relied upon a discredited dossier by British ex-spy Christopher Steele, who tried to use a discredited dossier to confirm collusion between the Kremlin and then-candidate Donald Trump and divert attention from investigations into Clinton’s emails while she was Secretary of State.

    The FISA application has at least 17 significant errors spanning from fall 2016 to summer 2017, which led the Office of Intelligence to fail in flagging important issues for discussion. Page was never charged for any wrongdoing and is seeking no less than $75 million for compensatory and special damages.

    “The more fundamental problem was that the FBI was so intent on obtaining a FISA warrant to enable it to spy on the Trump campaign that it did not fully and accurately disclose to the FISC the evidence it had obtained as to whether Dr. Page was a Russian agent. To persuade the FISC that there was probable cause to believe that Dr. Page was a Russian agent, the Defendants provided false or misleading information to the FISC,” Page’s lawyer explained.

    Page’s legal team also talked about the Defendant’s fabricated or intentionally disregarded critical evidence in order to obtain the FISA warrants. “This case is about holding accountable the entities and individuals who are responsible for the most egregious violation and abuse of the FISA statute since it was enacted over forty years ago,” Page’s lawyer explained.

    Chief FISA Judge Rosemary Collyer asked whether or not this puts the bureau’s reliability into question, now that there is documented proof to hurt the agency’s credibility. She criticized the agency for how they handled the surveillance applications and ordered DOJ Inspector General Michael Horowitz to inform the Court what they have done and plan to do with each FBI application. She pointed out the duty she has to protect the fourth amendment rights of each U.S person.

    “The frequency with which representations made by FBI personnel turned out to be unsupported or contradicted by information in their possession, and with which they withheld information detrimental to their case, calls into question whether information contained in other FBI applications is reliable,” Judge Collyer said.
