Canadian Court Rules it Was Legal To Deny Unvaccinated Person Organ Transplant

Alberta, Canada – A judge ruled that a woman who was denied organ transplants because she had not been vaccinated against Wuhan coronavirus did not violate her rights.

Court of Queen’s Bench Justice Paul Belzil ruled that Edmonton, Alberta woman Annette Lewis had not had her fundamental character of Rights and Freedoms rights violated by being denied an organ transplant over her vaccination status.

Justice Belzil says that the Canadian Charter of Rights and Freedoms does not influence the treatment decisions of doctors regarding organ transplants. However, Ms. Lewis was diagnosed by doctors as having the best chance of surviving a progressive illness, broadcaster CBC reports.

Lewis was diagnosed with the disease by doctors in 2018. She was advised to get vaccinations in 2020. However, she refused to take the Wuhan coronavirus vaccine. Without the vaccine, she wouldn’t be able to receive her potentially lifesaving transplant.

Lewis stated, “Taking this vaccine offends my conscience” and then added, “I ought not to have the choice about how my body is treated and a life-saving treatment can not be denied to me because I chose to not take an experimental treatment for COVID-19 — which is a condition I don’t have and may never have.”

Justice Bezil acknowledged that Lewis was the sole arbiter over what Lewis put in her body, but he stated that no one is entitled to an organ donation.

He said, “The notion that physicians would have to exercise clinical judgment in order to be treated under the charter would lead to medical chaos and patients would seek endless judicial review of their treatment decisions.”

This is not the first court case involving the rights of non-vaccinated Canadians in recent months. A father was denied visitation rights in Quebec, where he lived with his daughter. The judge had ruled that he couldn’t see his daughter because of his vaccination status.

Jean-Sebastien Vaillancourt, Superior Court Judge Jean-Sebastien Vaillancourt stated in his ruling that it would have been in the child’s best interests to contact his father. However, contact with him is not in his best interest if he isn’t vaccinated or opposes sanitary measures in the current epidemiological setting.

A similar ruling was issued by Judge Nathalie Godbout in the February Court of Queen’s Bench, temporarily denying custody to the father of his children. He also wasn’t vaccinated.

Justin Trudeau, Canada’s Prime Minister, has defended vaccine mandates, and other restrictive measures. He said in an interview last month that “it was their choice, and nobody ever was going force anyone to do something they don’t want to.”
